1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the website operated by Vidyut Automation and Calibration (“we”, “us”, “our”) at vidyutautomation.com and related pages (the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Separate agreements apply to commercial work. Quotations, purchase orders, supply, installation, commissioning, calibration, or maintenance services are governed only by written contracts, quotations accepted in writing, and applicable law—not by these Terms alone.

2. Use of the Site

You may use the Site for lawful purposes only. You agree not to misuse the Site, attempt unauthorized access to our systems or data, introduce malware, scrape the Site in a way that harms our infrastructure, or use automated means to overload the Site.

We may suspend or restrict access where we reasonably believe there is a breach of these Terms or a risk to security or service integrity.

3. Information on the Site

Content on the Site (including articles, descriptions of services, and technical summaries) is for general information and marketing. It is not engineering, legal, or safety advice for your specific installation. Decisions about equipment, standards, SIL/PL, electrical design, and regulatory compliance must be made with qualified personnel and appropriate documentation.

We aim to keep information accurate but do not warrant that the Site will be error-free or continuously available.

4. Intellectual property

Text, graphics, logos, layouts, and other materials on the Site (except where noted) are owned by us or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site for commercial use without our prior written permission, except as allowed by law (e.g. fair dealing or fair use).

5. Third-party links

The Site may link to third-party websites or tools. We are not responsible for their content, privacy practices, or availability. Following links is at your own risk.

6. Contact forms and communications

If you submit information through contact forms or email, you represent that the information is accurate to the best of your knowledge. You agree not to submit unlawful, misleading, or harmful content. We will use your contact details to respond to enquiries and, where relevant, for legitimate business follow-up, subject to applicable law.

7. Disclaimer and limitation of liability

To the fullest extent permitted by applicable law in India, the Site and all content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or inability to use the Site. Our total liability for any claim arising from these Terms or the Site (except where liability cannot be limited by law) shall not exceed the amount you paid us solely for access to the Site in the twelve (12) months before the claim; if no fee was paid, liability is limited to Indian Rupees one thousand (INR 1,000) where such a cap is permitted.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

8. Indemnity

You agree to indemnify and hold harmless Vidyut Automation and Calibration and its directors, officers, and employees from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Site or violation of these Terms, to the extent permitted by law.

9. Governing law and disputes

These Terms are governed by the laws of India. Subject to mandatory provisions of law, courts at Gautam Buddha Nagar, Uttar Pradesh, shall have exclusive jurisdiction over disputes arising from these Terms or use of the Site, without prejudice to our right to seek interim or protective relief elsewhere where permitted.

10. Changes

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Continued use of the Site after changes constitutes acceptance of the revised Terms. If you disagree with material changes, you should stop using the Site.
